Terms of Service

1. Overview

These Terms of Service ("Terms") govern your access to and use of our platform for AI-assisted interviewing, recording, transcription, analysis, and related features (the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

2. Eligibility and Accounts

• You must be at least 18 years old to use the Services.
• You are responsible for maintaining the confidentiality of your credentials.
• You agree that all registration information you submit is accurate and kept up to date.

3. Acceptable Use

You agree not to:

• Use the Services for unlawful, discriminatory, or deceptive purposes.
• Upload content that infringes third-party rights (e.g., IP, privacy).
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to reverse engineer or access non-public areas without authorization.

4. Interview Recordings, Transcripts, and AI

• By using audio/video rooms and enabling recording, you represent that you have obtained all necessary consents from participants to be recorded and transcribed.
• Our Services may leverage real-time communication infrastructure (e.g., LiveKit) and AI models (e.g., STT/LLM/TTS) to produce transcripts and analyses. You are responsible for reviewing any AI outputs before relying on them for decisions.
• You retain ownership of interview content (recordings, transcripts, and analysis outputs) that you generate, subject to these Terms.

5. Data Usage and Retention

• We process personal data of interviewers and candidates to provide the Services, including authentication, room state, transcription, and AI analysis.
• Retention settings may be configured in Settings. Otherwise, we retain data for as long as necessary to provide the Services or as required by law.
• You are responsible for configuring lawful retention periods and for exporting or deleting data where required.

6. Subscription, Billing, and Overage

• Paid plans are billed via Stripe. By subscribing, you authorize us and our processor to charge your payment method for recurring fees, taxes, and overage if enabled.
• Plans have included monthly minutes; usage beyond limits may incur overage at the rate specified for your plan when "Allow overage" is enabled.
• You can manage your subscription and billing details from the Billing tab or Stripe Billing Portal.

7. Intellectual Property

• We retain all rights in the Services, including software, UI, and documentation. No rights are granted except as expressly stated.
• You grant us a limited license to process your content solely to provide, maintain, and improve the Services.

8. Confidentiality

Each party will protect the other party’s Confidential Information and use it only for purposes related to the Services. Confidential Information excludes information that is public or independently developed.

9. Security

We implement administrative, technical, and organizational measures to protect data. However, no system is perfectly secure; you are responsible for safeguarding your credentials and configuring access controls appropriately.

10. Warranties and Disclaimers

• The Services are provided "as is" without warranties of any kind.
• AI outputs may be inaccurate or incomplete. You are solely responsible for reviewing outputs before using them for hiring or other decisions.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill.

12. Indemnification

You will defend, indemnify, and hold us harmless from any claims arising out of your use of the Services or violation of these Terms.

13. Term and Termination

• We may suspend or terminate access for violations of these Terms or to protect the integrity of the Services.
• You may cancel your subscription via the Billing Portal; account deactivation can be initiated from Settings.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Your continued use of the Services after changes become effective constitutes acceptance.
